Terms of Service

You must be at least 13 years old to use the Service, or the older minimum age that applies in your country to use online services without parental consent (16 in some countries of the European Economic Area). If you are under 18, or under the age of majority where you live, you may only use the Service with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use.

The Service contains fictional depictions of crimes, including murder, theft and disappearances, intended for a mature audience. You are responsible for deciding whether this content is suitable for you or for any minor in your care.

You may not use the Service if you are barred from doing so under applicable law or if we have previously suspended or terminated your account.

Criminal Atlas is an entertainment game of criminal investigation and deduction. All cases, characters, businesses, events and crimes are fictional. Real cities, neighborhoods and landmarks are used only as settings; any resemblance to real persons, living or dead, or to real businesses or events is purely coincidental and unintended. Nothing in the Service is a statement of fact about any real person, place or organization.

The Service is provided for personal entertainment only. It is not educational, legal, investigative, forensic or professional material, and it must not be relied on for any real-world purpose.

We may change, update, suspend or discontinue all or part of the Service, any feature or any content (including cases, cities, game modes, ranks, scores and rewards) at any time, with or without notice and without liability to you.

Some features require an account. You sign in with a one-time code sent to your email address. You must provide an email address you own and keep it accurate, and you are responsible for keeping access to that email secure and for all activity under your account.

Accounts are personal and non-transferable. You may not create accounts by automated means, share an account, or sell, rent or transfer it.

Tell us immediately at support (at) criminalatlas.com if you believe your account has been accessed without permission. We are not liable for any loss caused by the unauthorized use of your account.

Parts of the Service may be offered for a fee, including subscriptions. Prices, features and conditions are those shown at the time of purchase and may change in the future. Payments are processed by third-party payment providers (such as Stripe) under their own terms; we do not receive or store your full card details.

SUBSCRIPTIONS RENEW AUTOMATICALLY at the end of each billing period, at the then-current price, until you cancel. By subscribing, you authorize us and our payment provider to charge your payment method on each renewal. You can cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing period and you keep access until then.

We may change subscription prices. We will give you reasonable notice before a price change applies to your subscription, and you may cancel before it takes effect. Continuing your subscription after the change takes effect means you accept the new price.

EXCEPT WHERE REQUIRED BY APPLICABLE LAW, ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE, including for partially used billing periods, unused features or content, and accounts suspended or terminated for breach of these Terms. Any refund we grant is at our sole discretion and does not create an obligation to grant others.

Prices may not include taxes; you are responsible for any taxes that apply to your purchase, other than taxes on our income.

If you are a consumer in the European Union or the United Kingdom, you agree that access to digital content and services starts immediately after purchase and you acknowledge that you thereby lose your statutory right of withdrawal, to the extent permitted by law.

Some content is free, and some may be free only for a limited time. We decide which content is free or paid and may change it at any time. Free access, promotions and trials may be withdrawn or modified at any time and do not create any right to continued free access.

Experience points, ranks, streaks, medals, decorations, passport stamps, hint tokens, scores, percentiles and any other in-game items or progress ("Virtual Items") are a limited, personal, revocable license to use features of the Service. They are not your property, have no monetary value, cannot be exchanged for money or anything of value, and cannot be sold, transferred or traded.

We may modify, rebalance, recalculate, reset or remove Virtual Items and the rules that award them at any time (for example, to correct errors, change game balance or prevent abuse), without liability to you. Rankings, percentiles and statistics are approximate and are provided for entertainment only.

The Service uses artificial intelligence to create game content and to play characters you can question by text. AI output is generated automatically, can be inaccurate, inconsistent, incomplete or unexpected, and does not reflect our views. Characters are fictional and their statements are part of a game.

You must not rely on AI output for any purpose outside the game, and you use it at your own risk. We do not guarantee that AI characters will respond in any particular way, that their answers will be correct within the game, or that every question will receive an answer.

What you type to AI characters is processed by our AI providers to generate replies (see our Privacy Policy). Do not include personal, sensitive or confidential information in your questions.

You agree not to, and not to help anyone else to:

We may investigate any suspected violation and take any action we consider appropriate, including removing content, cancelling results or Virtual Items, and suspending or terminating accounts, without notice or liability.

You keep any rights you have in the text you submit to the Service (such as questions to characters). You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable license to host, store, process, reproduce, adapt and use that content to operate, maintain, analyze, secure and improve the Service and to create new content, subject to our Privacy Policy. You are solely responsible for what you submit.

If you send us suggestions, ideas or feedback, we may use them freely for any purpose without any obligation or compensation to you.

The Service and all its content, including cases, stories, characters, texts, images, logos, the Criminal Atlas name and brand, software, designs and game mechanics, are owned by VertiTech Innovations, LLC or its licensors and are protected by intellectual property laws. Except for the limited license below, no rights are granted to you.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Service for your personal, non-commercial entertainment. You may share your results using the sharing features we provide.

By creating an account you agree that we may send you emails needed to provide the Service (such as sign-in codes and account notices) and notifications about the game and your activity in it (such as the new Daily Case each morning, new investigations, streak reminders and rank promotions). You can turn off notifications at any time from your profile or with the link included in each email; service emails cannot be turned off while you keep an account.

The Service relies on third-party services (such as hosting, email, payment, security and AI providers) and may contain links to third-party websites or apps. We do not control them and are not responsible for their content, availability, security or practices. Your use of them may be subject to their own terms.

You may stop using the Service and delete your account at any time from your profile. Deleting your account permanently deletes your progress and cannot be undone. Deleting your account does not cancel a paid subscription billed through a third party unless the cancellation is completed as described in section 4.

We may suspend or terminate your access to all or part of the Service, or delete your account, at any time and for any reason, including breach of these Terms, suspected fraud or abuse, legal requirements or prolonged inactivity, with or without notice and without liability to you. If we terminate a paid subscription without cause, we may refund the unused part of the current billing period; no refund is due if termination results from your breach.

Sections that by their nature should survive termination will survive, including sections 6, 9, 10 and 14 to 21.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, INCLUDING AI OUTPUT, ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT ANY CONTENT OR PROGRESS WILL BE PRESERVED, THAT CASES WILL BE FREE OF LOGICAL ERRORS, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS. YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL VERTITECH INNOVATIONS, LLC, ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PROGRESS OR VIRTUAL ITEMS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50).

These limitations are an essential part of the agreement between you and us and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless VertiTech Innovations, LLC and its affiliates, members, managers, officers, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your use or misuse of the Service, your content, your breach of these Terms or your violation of any law or third-party right.

Informal resolution first. Before starting any claim, you agree to contact us at support (at) criminalatlas.com with a description of the dispute and to try to resolve it informally for at least sixty (60) days.

Binding arbitration. If we cannot resolve it informally, any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration may be held online or by phone, or at a location reasonably convenient to you. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property rights or to stop unauthorized use of the Service.

CLASS ACTION AND JURY TRIAL WAIVER. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person.

Opt-out. You may opt out of this arbitration agreement by emailing support (at) criminalatlas.com within thirty (30) days after first accepting these Terms, stating your name, your account email and that you opt out of arbitration.

Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.

If the class action waiver is found unenforceable for any claim, that claim must be decided in court and not in arbitration. If any other part of this section is found unenforceable, the rest remains in effect.

These Terms and any dispute are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-law rules. Subject to section 17, the state and federal courts located in the State of Delaware have exclusive jurisdiction, and you consent to their personal jurisdiction and venue.

If you are a consumer living in the European Union, the United Kingdom or another country whose laws give you mandatory protections, nothing in these Terms takes away the rights you cannot waive under the law of your country of residence, and you may also be entitled to bring proceedings in its courts.

We may modify these Terms at any time. We will post the updated Terms with a new "Last updated" date and, for material changes, may also notify you by email or in the Service. Changes take effect when posted unless we state otherwise. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not agree, you must stop using the Service and may delete your account.

These Terms, together with the Privacy Policy and the Cookie Policy, are the entire agreement between you and us about the Service and replace any prior agreement. If any provision is found invalid or unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our written consent; we may assign them freely, including in a merger, acquisition or sale of assets.

We are not liable for any delay or failure caused by events beyond our reasonable control, including outages of third-party providers, internet failures, natural disasters, acts of authorities, labor disputes or cyberattacks. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.

These Terms are offered in English and Spanish. If there is any conflict between versions, the English version prevails, to the extent permitted by law.
